(Print First/Last Name)(herein after “Releasor”), acknowledge and agree to the following terms and conditions for the use of facilities for camping and participation in activities provided by Jennen Properties LLC d/b/a Jackson Bluff Ranch or The Ranch at Jackson Bluff (herein after “Jackson Bluff Ranch”).
1. Assumption of Risk. Releasor understands that camping and outdoor activities at the Jackson Bluff Ranch involve certain inherent risks, including but not limited to: environmental risks such as weather conditions, insects, and wildlife; physical risks such as tripping, falling, sprains, and even death; risks associated with campfires, cooking, and other camp activities such as live entertainment; risks associated with swimming, boating, and water-related activities; risks related to the use of any provided equipment or facilities. RELEASOR UNDERSTANDS THAT I AM SOLELY RESPONSIBLE FOR MY SAFETY AND WELL-BEING DURING MY STAY AT THE JACKSON BLUFF RANCH.
2. Release of Liability. Releasor releases, waives, discharges, and holds harmless Jackson Bluff Ranch, its owners, members, employees, agents, and representatives from any and all claims, liabilities, demands, and causes of action, whether at law or in equity, arising out of or related to any injuries, losses, or damages that may occur during my stay at the Jackson Bluff Ranch, also including but not limited to, liability arising from the negligence or fault of Jackson Bluff Ranch, for personal injury, death or disability, property damage, theft or actions of any kind which may occur at the Jackson Bluff Ranch.
3. Indemnification. Releasor agrees to defend, indemnify, and hold Jackson Bluff Ranch harmless from and against all claims, demands, actions, suits, damages, liabilities, losses, settlements, judgments, costs, and expenses, including attorneys’ fees, arising out of or related to any third party claims which arise out of, relate to or result from any act or omission of Releasor, and in each case whether or not caused in whole or in part by the negligence of Jackson Bluff Ranch, or any other indemnified party, and whether or not the relevant claim has merit. Releasor acknowledges that Jackson Bluff Ranch is not responsible for the errors, omissions, acts, or failure to act of any party or entity participating in the activities at Jackson Bluff Ranch.
a. Emergency Medical Treatment. In the event of a medical emergency, Releasor authorizes Jackson Bluff Ranch to seek medical treatment on my behalf. Releasor understands that I am responsible for any medical expenses incurred.
4. Governing Law and Venue. This Waiver and Release of Liability is governed and construed in accordance with the laws of the State of Arkansas. Any dispute arising out of this Waiver and Release of Liability will be heard in a court of competent jurisdiction located in the State of Arkansas.
Releasor acknowledges that I have read and fully understand the terms of this Waiver and Release of Liability. I am aware that by signing this Waiver, I am giving up substantial rights, including my right to sue Jackson Bluff Ranch.
Releasor read and voluntarily signed this Waiver and Release of Liability.
